C.R.M. (A) 810 of 2022 22.03.2022 Sl. 90 Court No.29 Sc/SD (Rejected) In Re: - An application for anticipatory bail under Section 438 of the Code of Criminal Procedure filed on 15.02.2022 in connection with Md. Bazar P.S. Case No. 320 of 2021 dated 02.12.2021 under Sections 341/323/325/326/307/506/34of the Indian Penal Code.
And In the matter of: Halima Bibi & Anr.
....petitioners.
Mr. Sujoy Sarkar ...for the petitioners.
Mr. Navanil De ...for the State.
Petitioners seek anticipatory bail.
Learned advocate appearing for the petitioners submits that the petitioners are falsely implicated. There is a counter case amongst the private parties.
Learned advocate appearing for the State draws attention of the Court to the statement of the injured recorded under Section 161 of the Code of Criminal Procedure and also the injury report. The injured suffered fracture. The injured names both the petitioners as the persons involved in the incident in the statement under Section 161 of the Code of Criminal Procedure. Considering the gravity of the offence and the involvement of the petitioner therein, we are unable to grant anticipatory bail to the petitioners.
Accordingly, the prayer for anticipatory bail of the petitioners is rejected.
C.R.M. (A) 810 of 2022 is, thus, dismissed.
