Petitioner submits that the petitioner intends to produce the documents relating to the transactions which do nullify the case and the cause of action for which the FIR has been registered at the instance of the opposite party no.2 by way of an application under Section 156(3) of the Code of Criminal Procedure. Learned advocate also submits that the factual aspects itself reveal that the case was instituted after six years and by incorporating a different colour, the cause of action has been invoked for registration of the FIR. Be that as it may, the petitioner would be at liberty to submit all the documents before the investigating agency as I find that the present case being Joypur Police Station Case No.257 of 2023 dated 18.10.2023 was registered for investigation almost four months ago. The investigating agency would assess regarding the materials produced by the present petitioner and take into account while continuing with the investigation of the case. With the aforesaid observations, CRR 519 of 2024 is disposed of.
Pending connected application, if any, is consequently disposed of.
