The respondents Munna Ram, Baleswar Rai, Gobina Ghosh & Chandreswar were the accused persons in connection with the said Special Case. This appeal is pending since 1985. Mr. Saswata Gopal Mukherjee, learned Public Prosecutor fairly submits that he has no instruction from the State as to further proceeding of the appeal. Learned Public Prosecutor fairly submits that the Court may pass necessary order as the Court deems it proper.
From the case record I find that despite exhausting all the processes, the respondent/accused persons could not be brought on record in connection with this appeal. I have minutely read the judgment passed by the learned trial Judge. What I perceive, the learned Jude has rendered the judgment after proper appreciation of the evidence-on-record. I find no reason to interfere with the judgment of the learned Court below.
In view of the above, the appeal is dismissed. The judgment and the order of acquittal passed by the learned trial Judge is confirmed.
