Case No. 348 of 2021 dated 28.10.2021 under sections 306/120B of the IPC.

Advocate additionally submits that the investigation is complete and there are no reasons to submit another report in the form of Section 173 of the cr.p.c. when the petitioners challenge the issue relating to abetment in respect of the case being registered under sections 306/120B of the IPC.

I find from the records of the case that the case was registered on 28.10.2021. More than two years four months have passed since then. The police authorities, at

this advanced stage, should be allowed to exercise their discretion.

Hence, no interference is made by this court at this advanced stage.

The investigating agency will take the investigation to its logical conclusion and submit their report and their conclusion under section 173 of the cr.p.c.

It would be the discretion of the investigating officer to either implicate the persons named in the FIR and/or discharge them, but, this court restrains itself from giving any opinion on the issue.

With the aforesaid observations, CRR 517 of 2024 is disposed of.

Pending application, if any, is also disposed of. CD be returned to the ld. Advocate for the State. Report so submitted be kept with the record.
