The petitioner would be appearing in the ensuing Madhyamik Examination 2025 scheduled to be held on and from February 10, 2025 as a bona fide student of Kanthalberia Harihar High School (H.S.), Baruipur, District - 24 Parganas (South). The grievance of the petitioner is that though she was duly registered with the West Bengal Board of Secondary Education, but till date, the admit card for the said examination has not been issued to her. The petitioner is praying issuance of the said Admit Card.
Due to the mistake on the part of the school in uploading the particulars of the petitioner in the portal designated for enrolment of the students of Madhyamik Examination, 2025, the admit card has been issued to another student of the name sake to the petitioner though she is not eligible to take up the said examination as she has failed in the test. The admit card so issued has not been handed over to the said student.
Ms. Koyeli Bhattacharyya, learned advocate for the Board submits that the school, in spite of having the opportunity, did not rectify the said error.
Heard learned advocate for the parties and perused the materials on record.
The Board has issued the admit card to Ms.
Rubina Khatun, D/O Kamal Laskar, a student of the school who had failed to qualify the test for the Madhyamik Examination, 2025 as the school had mistakenly uploaded her particulars in the said designated portal instead of the particulars of Ms. Rubina Khatun, D/O Ansar Molla, the petitioner herein.
The petitioner, without any fault of her own, is facing unnecessary anxiety before her first Board examination.
The Board, however, as a respite for the students who have not been enrolled, has decided to reopen the said designated portal and to keep it open till 2 P.M. on February 07, 2025, enabling the schools to upload the particulars of the left out bona fide students for enrolment.
Ms. Bhattacharyya submits that the Main Office of the Board shall remain open from 11:00 a.m. till 2.00 p.m. on February 08, 2025 and on February 09, 2025.
The school shall now approach the Board on the aforesaid date(s) within the said stipulated time for enrolment of the petitioner with the Board and shall get the signature of the petitioner in the hard copy of the enrolment application to be submitted along with all relevant documents with the Deputy Secretary (Examination) of the Board and upon payment of the enrolment fees, stationary fees and late processing fees, the Board shall enroll the petitioner for the Madhyamik Examination, 2025 and shall issue the admit card which the school shall collect and deliver to the petitioner at her residence on February 09, 2025 itself.
The school shall take steps for cancellation of the enrolment of the said unsuccessful student of the
school and shall hand over the Admit Card already issued to the said student to the Board.
W.P.A. 2978 of 2025 is disposed of with the above terms without any order as to costs.
