Re: CO No. 407 of 2024
1. The present application has been filed with an innocuous prayer for early disposal of the applications filed by the defendants/opposite parties under Sections 7(1) and 7(2) of the West Bengal Premises Tenancy Act, 1997 (in short "the 1997 Act") in the eviction suit initiated by the plaintiffs/petitioners.
2. In view of the innocuous nature of the prayer which, if granted, shall not affect the substantial rights of either party, service of notice on the opposite parties is dispensed with.
3. C. O. No. 407 of 2024 is disposed of by requesting the learned Civil Judge (Junior Division), Seventh Court at Howrah, to
dispose of the pending applications under Sections 7(1) and 7(2) of the 1997 Act filed by the defendants/opposite parties in Title Suit No. 397 of 2022 as expeditiously as possible, upon giving adequate opportunity to the plaintiffs/petitioners to file written objection (if not already filed) and upon hearing the parties on the said application, preferably within November 30, 2025.
4. There will be no order as to costs.
5. In the event the regular Presiding Officer of the said Court is not available, it will be open to the petitioners to move the concerned District Judge for allocation of the matter to a different court, in which case, the aforesaid request shall apply to the court in charge of the suit as well.
6. Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
