The respective Reports filed on behalf of the Kolkata Municipal Corporation (KMC) and the State respondents are also taken on record.

The petitioner has preferred the present writ petition alleging unauthorized and illegal construction at premises no. 12/1, Chingrihata Lane, P.S. Tangra, Kolkata, allegedly undertaken by respondent no.8 with the consent of the other private respondents, who are land owners said premises.

Mr.
Banerjee, Learned Counsel for the respondent-Kolkata Municipal Corporation, submits that a demolition order under Section 400(8) of the KMC Act, 1980 has already been passed in respect of the impugned structure. It is further submitted that appropriate consequential steps in furtherance of the said demolition order shall be undertaken within a period of four weeks from date.

In view of the above submissions and assurance extended on behalf of the respondent KMC, learned counsel for the petitioner submits that the grievance raised in the present writ petition stands adequately addressed. Accordingly, he does not wish to press the present writ petition any further.

In the light of the above, the present writ petition is disposed of.

Since no affidavits have been filed by the respondents, the allegations made in the writ petition shall not be deemed to have been admitted.

There shall be no order as to costs.
9.
Let urgent Photostat certified copy of this order, if applied for, be supplied to the parties on usual undertaking.
