And In Re : Abdul Ali Mondal ..... petitioner Ms. Minoti Gomes Mr. Joy Chakraborty ... for the petitioner Mr. Debabrata Chatterjee Mr. Santanu Chatterjee ... for the State Ms. Puja Goswami .... for the de facto complainant Learned Counsel for the petitioner submits he is in custody for 2 years and 15 days. He is the husband of the victim lady. Co-accuseds are on bail. Inspite of direction of this Court charge has not yet been framed. He prays for bail. Learned Counsel for the State submits report. Learned Counsel for the de facto complainant also opposes the prayer for bail.

From the report it appears delay in framing charge is due to illness of the Presiding Officer. There are materials to implicate the petitioner in the crime. In view of the aforesaid circumstances, we are not inclined to grant bail to the petitioner at this stage.

The application for bail is, thus, rejected.
