Petitioner is aggrieved by the fact that in spite of informing the police station on or about 07.01.2025 in respect of the assault being inflicted upon them at the behest of the private respondent, no action has been taken by the police authorities. Learned advocate for the State has submitted a report. Report reflects that police authorities have already registered a case pursuant to the complaint being Joypur PS Case No. 24/25 dated 13.02.2025 under the relevant provisions of law.
Petitioner is also aggrieved by the fact that the present incident happened as earlier in spite of informing the police authorities, proper steps were not taken pursuant to directions passed by the Hon'ble High Court also.
Having considered that the respondent is adamant in pursuing his illegal objective, I direct that the learned ACJM would if the respondent so appears or surrenders before the court impose condition to the extent if he is satisfied that the presence of the respondent may further create breach of the peace, he may be directed for a scheduled period of time to stay outside the jurisdiction of the police station. It is reiterated that learned Magistrate will apply his mind to that effect and not unilaterally follow the direction of this court. To that effect, if required learned Magistrate will call for a preliminary enquiry report from the police authorities concerned. With the aforesaid observations WPA 3095 of 2025 is disposed of.
Report so submitted be kept with the record.
A copy of the report be handed over to the learned advocate appearing for the petitioner. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
