Learned counsel for the CESC Limited files a report, which is kept on record, indicating that the CESC Limited, fairly enough, is agreeable to give electricity connection at the proper address of the petitioner, since it was discovered upon inspection that the address given in the application for new connection is incorrect.
Learned counsel for the petitioner submits that his client is agreeable to apply afresh by giving the correct address.
However, since there is apprehension of resistance on the part of the respondent no. 4 and his men and agents, WPA No. 2777 of 2022 is disposed of by directing the CESC Limited to give electricity connection to the petitioner, subject to the petitioner applying afresh and complying with all formalities in respect of the correct address on which such connection is sought.
In the event the CESC Limited personnel face any obstruction or hindrance in giving such connection, it will be open to the personnel of the CESC Limited to approach the respondent no. 3, that is, the Officer-in-Charge, New Alipore Police Station, to grant adequate police assistance in that regard. If so approached, the respondent no. 3 shall grant such police assistance at the cost of the petitioner for the limited purpose of giving such connection. It will also be open to the respondent no. 3 to break open any padlock or other hindrance, if created, in the way of access of the CESC Limited personnel to the locale for the purpose of giving such connection.
It is expected that the CESC Limited shall give such connection to the petitioner as expeditiously as possible, preferably within a week from the date of compliance of formalities by the petitioner, upon prior filing of a proper application with the correct address. There will be no order as to costs.
Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
