Learned counsel for the petitioner submits that the petitioner initially joined as third Sahayika at Velian Sishu Shiksha Kendra in 2004 and joined the said post on 1st August, 2004. She was transferred to Kalitha Sishu Shiksha Kendra on the basis of the representation made by her on medical grounds and joined there on 23rd December, 2024. By an order passed on 24th April, 2025, she was again sent back to Velian Sishu Shiksha Kendra without assigning any reason therefor. When the petitioner went to join the said posting, she was restrained by one lady Farida Khatun. The petitioner was informed that a mass petition was filed requesting that the petitioner should not be allowed to join the post. A show cause notice was issued upon the petitioner by the concerned authority pursuant to which her honorarium was directed to be withheld for the month of September, 2025. However, learned counsel submits that the petitioner has not received any honorarium since then. The petitioner submitted a

representation seeking permission to join the new posting as well as release of her honorarium before the concerned authority on 5th December, 2025 which is yet to be considered. The petitioner seeks consideration of the representation.

Denying the contention of the petitioner, learned counsel for the State submits that the petitioner has relied upon old medical documents to demonstrate her illness. She has not given a befitting reply to the show cause notices issued upon her, nor has she complied with the direction of the authority to join the concerned Sishu Shiksha Kendra.

Upon consideration of the submission made on behalf of the parties, this Court is inclined to hold that since the representation submitted on behalf of the petitioner is yet to be considered, the Sub Divisional Officer, Rampurhat Sub Division, being the 4th respondent herein, is directed to consider and dispose of the representation within two weeks from the date of communication of this order upon affording reasonable opportunity of hearing to all concerned including the petitioner/her authorised representative, in accordance with law.

The decision taken by the authority shall be communicated to the petitioner within a week thereof. The writ petition is accordingly disposed of.

There shall however, be no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to have been admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
