Learned advocate appearing for the petitioner submits that the petitioner is in custody for 1 year 4 months and the subject matter of the seizure relates to recovery of 400 grams of heroin. Learned advocate draws the attention of the Court to the four witnesses who have already been examined and deposed before the learned trial court.

Learned advocate for the State opposes the prayer for bail.

On an assessment of the deposition of the witnesses, although the time period earlier stated till date has not been completed but this Court is of the view that rigors of Section 37 of the NDPS Act is diluted. As such, the prayer for bail of the

petitioner is allowed. The petitioner, namely, Humayun Sk @ Humayan Sk shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties of Rs.10,000/- each, one of whom must be local to the satisfaction of the learned Additional District and Sessions Judge, 2nd Court-cumlearned Judge, Special Court, under NDPS Act, Berhampore, Murshidabad. If on bail, the petitioner shall be physically present on each and every date fixed by the learned trial court and shall not leave the jurisdiction of the district of Murshidabad without the prior permission of the learned special court. Accordingly, CRM (NDPS) 269 of 2026 is allowed. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
