The petitioner is aggrieved that the private respondent, who was the I. C. of the Bagnan Police Station has illegally demolished a wall standing on her land.

Counsel for the State has produced instructions dated 09.11.2022 and the same is taken on record. It is submitted that a joint measurement was conducted in respect of the land on which the wall stood, by the Revenue Inspector in presence of the petitioner and the Bagnan Police. The petitioner has admitted that she has been illegally occupying 0.64 decimals of land that in fact stood in the name of the Bagnan Police Station.

There are proceedings in respect of the said property with the West Bengal Land Reforms and Tenancy Tribunal.

In view of the above, no relief can be granted to the petitioner in the instant proceeding.

The private respondent no. 5 is no longer with the Bagnan Police Station. The allegation against the private respondent appears to be baseless and motivated.

In those circumstances, token costs of Rs.100/- shall be payable by the petitioner to the private respondent no. 5.

Since no affidavits have been called for by this Court, the allegations in the writ petition shall not be deemed to have been admitted by any of the respondents.

The writ petition is disposed of.
