The petitioner is aggrieved that an application for holding rally from Sealdah Station to Rani Rashmoni Avenue on 9th February, 2023 has been declined by the Joint Commissioner of Police (HQ), Kolkata Police.

Across the bar counsel for the petitioner has suggested two alternative dates i.e. on 16th or 17th February, 2023.

The Office of the Joint Commissioner of Police (HQ), Kolkata Police has communicated that they have no objection to the petitioner's holding the rally on 17th February, 2023 between 12 Noon to 4:00 P.M. from Sealdah Station to Rani Rashmoni Avenue.

The petitioner may hold the rally as above and converge at Sahid Mihar and hold a gathering. The petitioner undertakes before this Court to hold a peaceful rally and clean up the area after completion of their demonstration.

The report of the Joint Commissioner of Police (HQ), Kolkata Police dated 6th February, 2023 in the form of instructions to the State Advocate be taken on record.

With the aforesaid directions, the instant writ petition shall stand disposed of.

There will be no order as to costs.
