Kausik (Rejected) CRM (NDPS) 271 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Muchipara Police Station Case No. 159 of 2023 dated 20.10.2023 under section 20(b)(ii)(c)/29 of the NDPS Act.

Learned advocate appearing for the petitioner submits that petitioner is in custody for 2 years 4 months and the recovery in this case relates to 83 Kgs. of Ganja from joint possession of the petitioner and others.

Learned advocate has drawn the attention of the Court to the order sheet and submitted that at least on the last 4 occasions there were no efforts on behalf of the prosecution to proceed with the case.

Learned advocate for the State opposes the prayer for bail and submits that on 11 occasions defence has prayed for time.

Be that as it may, as a matter of last chance, I direct the prosecution to make substantial progress in the trial and complete at least the vital witnesses required to fortify the charges framed.

As 83 Kgs. of Ganja has been recovered, the prayer for bail is rejected. Petitioner if so advised would renew the prayer for bail after 4 months.

Accordingly, CRM(NDPS) 271 of 2026 is dismissed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
