The civil revision has been preferred challenging an order dated 03.01.2024 passed by the State Consumer Disputes Redressal Commission, in Appeal No. A/409/2023 arising out of Complaint Case No. 59 of 2020. 3.

Vide the impugned order, the Commission has been pleased to dismiss the appeal on the ground of limitation for the inordinate delay of 209 days. The Commission was not satisfied with the cause shown by the appellant therein.

On perusal of the impugned order and the grounds as made out before the Commission stating the reasons and the cause for the delay, this Court finds that sufficient cause was shown by the appellant therein and the same should have been accepted.

This Court on perusal of the cause shown finds that the same is sufficient and the delay in preferring the appeal condoned in the interest of justice and is set aside.

The appeal being no. No. A/409/2023 arising out of Complaint Case No. 59 of 2020, is hereby restored to its own file and number, for disposal by the said State Consumer Disputes Redressal Commission, on proper notice to the other sides, in accordance with law.

Civil revision stands disposed of.

Connected application, if any, stands disposed of.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
