The petitioner is directed to pay interim maintenance at the rate of Rs.40,000/- per month as directed by the learned Magistrate by its order dated 15.07.2022. So far as the amount claimed in the execution case is concerned, the same be disbursed by four equal monthly instalments. The petitioner is directed to pay the interim maintenance at the rate of Rs.40,000/- per month on and from the month of February 2023, if not paid till date. The learned advocate for the petitioner canvasses the issue relating to payment of EMI towards the house-building loan.

The petitioner would be at liberty to bring the same to the notice of the learned Magistrate and pray for alteration of the quantum of interim maintenance so granted. With the aforesaid observations, the revisional application being CRR 431 of 2023 is disposed of. All pending connected applications, if any, are consequently disposed of.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
