The grievance of the petitioners is that till date the dispute case has not yet been disposed of.

Mr. Sureka, learned advocate appearing for the Cooperative Societies submits that the Additional Director of Fisheries, West Bengal as Ex-officio Additional Registrar of Cooperative Societies West Bengal is the Ex-officio Assistant Registrar of Cooperative Societies in respect of all the fisheries within the jurisdiction of the respective district. He thus submits that the petitioners have not approached the appropriate authority ventilating their grievances.

On a query of the Court, Mr. Sureka, learned advocate for the respondent No.3 submits that the decision on the application filed by the petitioner under Section 102 of the 2006 Act and has not been communicated to the petitioners till date.

Without entering into the merits of the claim made by the petitioners in the application under Section 102 of the 2006 Act, which is annexed at page 64 of the writ petition, this Court directs the Registrar of Co-operative Societies, being the respondent No.3 to consider the application of the petitioners filed under Section 102 of the 2006 Act and to dispose of the same by passing a reasoned order as expeditiously as possible and in accordance with law.

If such the authority is of the opinion that the decision on such application does not fall within his domain, such decision shall also be communicated to the petitioners. The entire exercise shall be completed by the respondent No.3 as expeditiously as possible but positively within a period of 4 weeks from the date of receipt of a server copy of this order.

Mr. Nayak, learned advocate appearing for the respondent Nos.2 and 5 submits that the Cooperative Election Commission is ready and willing to conduct the election subject to the resolution of the dispute between the members inter se. Such submission is placed on record.

With the above observation, WPA 3144 of 2026 stands disposed of.

There will be no order as to costs.
