Mr. Satyam Mukherjee Mr. Purnendu Shekhar Ghosh ...for the petitioner This civil revision application under Article 227 of the Constitution of India is at the instance of the plaintiff praying for a direction upon Learned Civil Judge (Sr. Division), Barasat to dispose of TS No. 720 of 2022 expeditiously.

Learned advocate appearing for the petitioner submits that an applications under Order 1 Rule 10(2) and Order 6 Rule 17 of the Civil Procedure Code are pending. He further submits that September 24, 2026 is the next date fixed for hearing of the aforesaid applications.

He submits that the aforesaid applications are otherwise ready for hearing. In view of the order sought and proposed to be passed, there is no necessity to direct issuance of any notice upon the opposite parties. However, the learned advocate-on-record of the petitioner shall be obliged to forward a copy of this application along with this order, upon the opposite parties or upon the

learned advocate representing the opposite parties before the learned trial judge forthwith.

In the light of the submission made by the learned advocate appearing for the petitioner, CO 545 of 2026 stands disposed of by requesting the Learned Civil Judge (Sr. Division), Barasat to take up the hearing of the applications under Order 1 Rule 10(2) and Order 6 Rule 17 of the Civil Procedure Code on the next date fixed, if the same are otherwise ready for hearing and to make an endeavour to dispose of the same as expeditiously as possible without granting any unnecessary adjournments to either of the parties.

However, it is made clear that it will be open to the learned trial judge to decide as to which of the aforesaid applications shall be taken up first. (Hiranmay Bhattacharyya, J.)
