Learned advocate appearing on behalf of the petitioner has submitted that the revisional application was filed with a prayer for transfer of Sessions (MTB) 155 of 2016 arising out of Sitalkuchi Police Station Case No. 64 of 2015 dated 17.02.2015 under Section 376(2)(n)/506 of the Indian Penal Code from the Court of learned Additional Sessions Judge Mathabhanga, Cooch Behar to the learned Additional Sessions Judge, Jalpaiguri. But at this stage learned advocate appearing on behalf of the petitioner has submitted that the said Sessions Case being No. (MTB) 155 of 2016 had already been disposed of long back and challenging the judgment appeal preferred which is pending and appellant is on bail.

Accordingly, it is submitted that the instant application being infructuous and liable to be dismissed. Accordingly, the revisional application stands dismissed as being infructuous.
