Petitioner is aggrieved by the fact that in spite of informing the police station no steps have been taken in respect of the cognizable offence having been made out. Particularly, with regard to the gold ornaments which has been the subject matter of the case.

Learned advocate for the State has submitted a report. Report reflects that Bhowanipore PS Case No. 28 dated 01.02.2025 under Sections 307/3(5) of the BNS, 2023 has been registered for investigation and the investigation has been continuing. Report also reflects that statements have been recorded. The gold which were handed over for loan is lying with one of the NBFCs. Police authorities as a subject matter of the case will seize

such gold and may keep in the possession of the finance company concerned who is in possession after a bond is furnished before the learned Magistrate who is in siesin of the case.

Since the police authorities are taking steps at this stage there is no further scope for interference by this Court.

Accordingly, WPA 3014 of 2025 is disposed of. Report submitted by the State be kept with the record.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
