The petitioners have approached this Court as their representation to the Officer-in-charge of Penro Police Station, Amta-1, Howrah dated 03.02.2025 has not been considered.

Without going into the details of the accusations made therein, the apprehension expressed by the petitioners regarding Sayan Dalui, son of the petitioner no.1 to sit in the Board Examination, this Court directs that the son of the petitioner no.1, namely, Sayan Dalui, who is sitting in the Board Examination which is to be held at the venue Amta Nityananda High School on and from 10th February, 2025, should not be obstructed and/or disturbed while leaving his home and attending the venue of the examination.

To that effect, if any information is furnished with the concerned police station, the police authorities would ensure that the said Sayan Dalui has all access to the examination venue on the date so fixed.

In case, any resistance is offered by any of the persons named in the information dated 03.02.2025, the police authorities will not deter to register an FIR and shall take the person(s) in custody in connection with the information furnished. So far as the other accusations made in the information dated 03.02.2025 is concerned, the police authorities would deal with the same in accordance with law.

Needless to state that since affidavits have not been invited from the State, the allegations made against the State in the writ petition is deemed not to have been admitted.

With the aforesaid observations WPA 3025 of 2025 is disposed of.

There will be no order as to costs.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
