The State of West Bengal Mr. Amitabha Karmakar Mr. Dhananjay Mukherjee Mr. Arup Kumar Bhowmick Mr. Partha Sarathi Mishra ...for the Petitioner In this application, the petitioner being the senior citizen aged about 79 years, has prayed for a direction upon the Trial court for expeditious disposal of G.R. case no. 817 of 2015, presently pending before the learned Judicial Magistrate, Ghatal.

It is submitted on behalf of the petitioner that the FIR of the instant proceeding was lodged on 3rd December, 2015 and the charge-sheet was submitted on 31st December, 2016. The trial has commenced on 3rd January, 2020 and till then for the last five years, only six witnesses out of nine witnesses have been examined so far. It has now become unpredictable as to when the trial would conclude and as such, he prayed for necessary direction invoking this court's jurisdiction under Section 529 of the BNSS.

Having heard learned counsel for the petitioner, it appears that the prayer made by the petitioner is innocuous and if it is allowed in terms of the prayer made in the application, the opposite party will have no cause to prejudice

and as such, the service of copy of the application upon the opposite party is dispensed with.

Since the prayer made by the petitioner is justified in terms of the long pendency of the proceeding, the instant application being CRR 597 of 2025 is hereby disposed of with a direction upon the court below to make every endeavour for expeditious disposal of the aforesaid G.R. case no. 817 of 2015, presently pending before the learned Judicial Magistrate, Ghatal, if possible by conducting day to day trial and also make his best effort to conclude the trial preferably within a period of six months from the next date of hearing without granting any unnecessary adjournment to either of the parties. Urgent Photostat certified copy of this order, duly applied for, be given to the parties upon compliance of all requisite formalities.
