The petitioner complains that he has been implicated in connection with Kumarganj P.S. Case No. 117/2024 dated 30.04.2024 under Sections 420/468 of the Indian Penal Code. After the petitioner was granted bail, the complainant who is an influential person is causing inconveniences and thereby trying to put the life of the petitioner at peril. The petitioner prays for police protection. Learned advocate appearing for the respondent no.5 submits that he has already applied for cancellation of bail which although was initially rejected, but against the said order, a fresh
application for cancellation of bail has been preferred before the learned Sessions Judge.
According to the respondent no.5, the petitioner is creating a circumstance for sympathy so that he can get an escape route in the present application for cancellation of bail pending before the learned Sessions Judge.
State has submitted a report. The same is to the extent that investigation of the case is in progress. Report also reflects that there has been collection of some materials.
In view of the nature of the prayer sought for in the present writ petition, I am of the opinion that since it has been claimed that the petitioner is an aged person, if he approaches the police station with prayers in respect of inconveniences caused from any corners, the police authorities would assess regarding any reason of insecurity and render appropriate assistance, if required.
As no affidavits have been called for, the accusations made against the private respondent and/or the State-respondents are deemed not to have been admitted.
With the aforesaid observations, the writ petition being WPA 3072 of 2025 is disposed of. There will be no order as to costs.
All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
