In the matter of:- Saikat Basu & Ors.

Mr. Chirantan Sarkar Mr. Avijit Ghosal .....for the petitioners Mr. Imran Ali Mr. Md. Kutubuddin .....for the State This is an application praying for an expeditious disposal of a proceeding in which a charge-sheet was submitted under Sections 498A and 406 of the Penal Code.

Let a copy of this application be served upon Mr. Imran Ali and Mr. Md. Kutubuddin, learned counsels, who are present in court today and who ordinarily appear on behalf of the State. Their engagement may be regularised in due course by the competent authority of the State.

Learned counsel appearing on behalf of the petitioners submits as follows. The petitioners are the accused in this case while opposite party no. 1 is the de facto complainant. Although an FIR was lodged on 22.11.2019 and a charge sheet was filed on 19.12.2019, till date the proceeding could not be concluded. Even, charges have not been framed. Long dates are being fixed. The matter has remained pending for no fault of

the present petitioners.

Learned counsel for the State submits that no inordinate delay has been occasioned in this case. In fact, due to huge workload of cases pending before the learned trial courts, there are NDPS cases pending where accused are suffering custody trial since 2018. I have heard submissions of the learned counsels appearing on behalf of the petitioners and the State and have perused the revision petition.

It does not appear that an inordinate delay has taken place in the present case.

Therefore, no further order need be passed in this regard.

However, it is expected that the learned trial court shall dispose of the case as expeditiously as possible. With these observations, the revisional application is disposed of.
