Learned counsel for the petitioner submits that the petitioner does not want to proceed any further with the writ petition and to withdraw the same, with liberty to approach the appropriate forum.

Upon hearing learned counsel for respective parties, such prayer is allowed, thereby dismissing W. P. A. 2173 of 2020 as withdrawn, with liberty to the petitioner to approach the appropriate forum according to the petitioner, in accordance with law, on the same cause of action.

It is further made clear that the merits of the writ petition have not been gone into and any of the observations made in this order shall not prejudice the rights and contentions of either of the parties in any other proceeding, if filed on the same cause of action before a different forum. There will be no order as to costs.

Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
