Petitioner approached the Inspector-inCharge, Burdwan Sadar Police Station complaining regarding the unlawful activities and demolition over the plot in question and in spite of receipt of such information no steps have been taken. Petitioner claims that he was running an M.R.

Distributorship/ Ration Shop from the said location. Records reflect that such information was dated 23.12.2024 and sent to the police station on or about 24.12.2024.

Police authorities have submitted a report.

Report reflects that at the relevant point of time, police authorities drew up proceedings under section 126/135 of the BNSS.

Learned advocate presently submits that the demolition has been carried out and the

petitioner has been thrown out from the said location at the behest of the private respondent and the police authorities are refusing to accept any information. The incident complained of is of August, 2025. The same is a changed circumstance, as such I direct the petitioner to ventilate the grievance before the Superior authorities of Police and thereafter prefer an application under section 175(3) before the Jurisdictional Court. Learned Jurisdictional Court would assess regarding the genuinity of the allegations and thereafter pass necessary directions as he deems fit and proper. With the aforesaid observations WPA 3078 of 2025 is disposed of.

Copy of the report be handed over to the learned advocate appearing for the petitioner.
