Let it be taken on record. Pursuant to the order dated 29.04.2025 a report has been received from the learned Judicial Magistrate, 5th Court, Alipore, South 24 Parganas. Perusal of the report indicates that one of the accused person did not appear and thus warrant of arrest were issued and now the case is fixed for execution report of the warrant.

Learned Judicial Magistrate has rightly reported that the matter cannot be proceeded with until the proceeding regarding presence of accused is complete. In the circumstances I consider that directions can be issued only to the extent that the matter be proceeded in accordance with the law. The concerned Superintendent of Police is also directed to ensure that execution report on arrest warrant are submitted in time.

Department is directed to send a copy of the order to the concerned Superintendent of Police.

Accordingly, CRR No. 601 of 2025 stands disposed of. (Dinesh Kumar Sharma, J.)
