Learned advocate appearing for the petitioner submits that petitioner is in custody for one year two months and the incident occurred at the spur of the moment.

Learned advocate for the State opposes the prayer for bail. Records reflect that out of 20 witnesses 6 witnesses have been examination till date.

Having regard to the fact that the genesis of the present case relates to disruption of water connection and no deadly weapons have been recovered from the present petitioner. Without entering into the merit of the case, I am inclined to release the petitioner on bail as some time will be required to take the trial to its logical conclusion. Accordingly, the prayer for bail of the petitioner is allowed.

As such, petitioner namely, Barun Ghosh shall be released on bail upon furnishing bond of Rs. 20,000/- (Rupees Twenty Thousand only), with two sureties of Rs. 10,000 (Rupees Ten Thousand only) each, one of whom must be local to the satisfaction of the learned Chief Judicial Magistrate, Murshidabad at Berhampore.

If on bail, the petitioner shall be physically present on each and every date before the learned trial Court in seisin of the case and shall not leave the jurisdiction of district of Murshidabad without the prior permission of the learned trial Court. Accordingly, CRM (M) 401 of 2026 is allowed.

All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
