Learned advocate for the petitioner submits that the petitioner is the brother-in-law and, even if, the allegations of the prosecution are taken to be true, he is involved in peripheral activities so far as the offence is concerned. Learned advocate for the State, on the other hand, opposes the prayer for bail and submits that the prosecution proposes to examine 19 witnesses in support of its case. The records of the case reflect that P.W.9 has already been examined in the de-novo trial.
Having considered that the prosecution has put in efforts to take the trial to its logical conclusion and the fact
that the petitioner was not available before the court for almost seven years, I am not inclined to enlarge the petitioner on bail at this stage.
Hence, the prayer for bail of the petitioner is Rejected.
Accordingly, CRM(M) 402 of 2026 is dismissed. Pending application(s), if any, is also disposed of.
