1. Affidavit of service filed in Court today is taken on record.
2. The petitioner participated in the recruitment process in the Central Armed Police Forces. He was declared medically unfit by the detailed medical examination board on the ground of deformity of terminal phalanx of little finger of left hand.
3. The review medical board came to the finding that the petitioner suffered from flexion contracture at distal interphalangeal joint of left little finger.
4. The petitioner refers to the guidelines of the recruitment medical examination and submits that the ground that has been found for disqualifying the petitioner is not mentioned in the guidelines.
5. It has been submitted that the review medical examination was not conducted in accordance with the recruitment rules. The x-ray
report which ought to have been annexed with the report of the review medical examination board has not been forwarded.
6. Prayer has been made to direct the authority to reevaluate/reexamine the petitioner by an independent authority.
7. The aforesaid submission of the petitioner is opposed by the learned advocate representing the Union of India.
8. On a perusal of the documents placed before this Court and those annexed to the writ petition, it appears that the finding of the review medical board more or less tallies with the finding of the detailed medical examination report.
9. As per the recruitment notification, the decision of the review medical board is final and no appeal can be entertained against the review medial board. A candidate participating in the recruitment process would be bound by the recruitment rules relying on which the recruitment process is being conducted.
10. As the petitioner participated for recruitment in the Central Armed Police Force, the medical certificate relied upon by the petitioner obtained from the State Government Hospital in support of the submission that he does not suffer from any such deformity, cannot be accepted.
11. The standard of fitness of a civilian is not always the same as required in the armed forces.
12. In view of the above, the prayer of the petitioner cannot be accepted. Accordingly, the writ petition fails and is hereby dismissed.
