(Via Video Conference) The matter was initially listed on 17.08.2009 but service was not completed and the matter was directed to be listed in the next monthly list. Again the matter was listed on 18.11.2009 but none appeared on behalf of the petitioner. The matter was again listed on 19.01.2010 but none had appeared on behalf of the petitioner and the case was adjourned.

The matter was again listed on 27.01.2010 and the petitioner was directed to inform the respondent and to file affidavit-of-service on the next date of hearing. The matter listed on 26th August, 2010 and this Court has directed to file affidavit within four weeks but as per report of the office no affidavits have been filed. On 7th December, 2017 the matter was referred to National Lok Adalat but none of the parties had appeared before the National Lok Adalat and thus the record was returned to this Court for adjudication. On 23.11.2021 again the matter was listed but none had appeared on behalf of the petitioner but in the

interest of justice, the matter was adjourned till today. Today also none had appeared on behalf of the petitioner to move the writ application.

It reveals from record that the petitioner is not interested to proceed with the matter.

Hence, the writ petition being WPA 1739 of 2009 is dismissed for default.
