Report submitted by Mr. Keshari, learned advocate appearing for the State be kept with the record. The present revisional application was preferred in connection with Behala Police Station Case No. 339 of 2005 dated 02.11.2005. It was submitted before this Court that there has been amicable settlement between the petitioner and the opposite party no.2.
The report so submitted is enclosed with the statement of Madhu Dhoot, the opposite party no.2 herein, along with her declaration. The statement reflects that the couple are residing together.
Having regard to the changed circumstances and the amicable settlement which has taken place between the parties, I am of the view that further continuance of Behala Police Station Case No. 339 of 2005 dated 02.11.2005 (B.G.R. No. 3948 of 2005) would result in harassment and complexities.
Accordingly, all further proceedings of Behala Police Station Case No. 339 of 2005 dated 02.11.2005 (B.G.R. No. 3948 of 2005) including the charge-sheet submitted therein as also the warrant of arrest so pending be hereby quashed. The revisional application being CRR 532 of 2024 along with CRAN 1 of 2024 is, thus, allowed.
All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
