Ashok Dey v. State Of West Bengal
13.02.2025 as [REJECTED] C. R. M. (A) 468 of 2025 In Re: An application for anticipatory bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Jorasanko Police Station Case No.219 of 2024 dated 07.12.2024 under Sections 61(2)/318(4)/316(5) of BNS, 2024.
In Re: Ashok Dey.
... ... Petitioner Ms. Nandini Chatterjee ... ... for the petitioner Mr. Bibaswan Bhattacharya Mr. Atulya Sinha ... ... for the State 1.
Petitioner submits he had taken a loan from the de-facto complainant and he has made part payment in respect of the loan. Accordingly, he prays for anticipatory bail.
2.
Learned Advocate for the State opposes the prayer for anticipatory bail. He submits petitioner and others had hatched a conspiracy and induced the de-facto complainant to pay money on the false promise of giving employment. Forged appointment letters and other documents were recovered in course of investigation. 3.
We have considered the materials on record. Petitioner is a member of a gang who dishonestly induced the victim and others to part with money on the false promise of giving employment. They had prepared fake appointment letters and even arranged fake training sessions for the prospective appointees.
4.
Keeping in mind the deep rooted conspiracy hatched by the petitioner and his associates to defraud the unemployed youth, we are not inclined to grant anticipatory bail to the petitioner. Signed By : ALOK SETH High Court of Calcutta 17 th of February 2025 02:33:24 PM
5.
Accordingly, the prayer for anticipatory bail of the petitioner is rejected.
