The petitioner participated in the recruitment process initiated by the Sub-Divisional Officer in terms of Notice No.10/ASHA/Suti-2/Jangipur2023 dated August 31, 2023. 2.

Submission of the petitioner is that the private respondent has been engaged without following the conditions as mentioned in the recruitment notice.

Specific case of the petitioner is that the private respondent does not reside within the locality where the ASHA has been recruited.

A representation by the petitioner dated March 27, 2024 with the aforesaid allegation submitted before the concerned authority is alleged to be kept pending.

None represents the State.

As it appears that the representation of the petitioner is alleged to be pending disposal for a considerable period of time, accordingly, no useful purpose will be served by keeping the writ petition pending.

Hence, the writ petition stands disposed of directing the Sub-Divisional Officer, Jangipur,

Murshidabad, the third respondent herein, to take a decision on the petitioner's representation dated March 27, 2024 in accordance with law at the earliest but positively within a period of twelve weeks from the date of communication of this order. A reasoned order shall be passed and communicated to the petitioner.

A reasonable opportunity of hearing shall be granted to all the necessary parties prior to passing a final order in the matter.

If the allegation of the petitioner is found to be true, then necessary consequential steps shall be taken without any further delay.

All parties are to act on the server copy of this order duly downloaded from the official website of this Court.

Certified copy of this order, if applied for, shall be made available to the parties.
