Several opportunities were given earlier despite of the fact nobody is present today to meet the application. It appears from the CAN application that the appellant has filed an application for withdrawal of the appeal and the amount deposited by the appellant for preferring an appeal on the ground that as per the decisions of the Hon'ble Supreme Court and this Hon'ble High Court, the appellant/Insurance Company is not willing to proceed with the instant appeal. Under such circumstances, there is no need to keep appeal pending further.

Accordingly, the prayer made for withdrawal of appeal in CAN application 1 of 2019 (Old CAN 2900 of 2019) is hereby allowed and consequently the instant appeal is dismissed as withdrawn.

The appellant is permitted to withdraw the statutory deposit, if any, Let the order of this Court be sent to the learned Tribunal for information.

Consequently, the appeal FMAT 94 of 2019 and CAN 1 of 2019 (Old CAN 2900 of 2019) and CAN 2 of 2020 (Old CAN 2888 of 2020) are thus disposed of with above observations.

Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
