Allowed C.R.M.(A) 474 of 2024 In Re:- In Re:- An application for anticipatory bail under Section 438 of the Code of Criminal Procedure in connection with Sabang Police Station Case No. 275 of 2017 dated 09.10.2017 under Sections 147/148/149/323/325/302/34 of the Indian Penal Code and Sections 25(i)(b)/35 of the Arms Act, 1959 read with Section 9(b)(ii) of Indian Explosive Act, 1884.

And In Re : Ananta Tunga @ Tung ...... petitioner Mr. Amit Ranjan Pati Ms. Swastika Chowdhury ...for the petitioner Mr. Partha Pratim Das Mr. A. Bhattacharya ...for the State Apparently, the petitioner stands on the same footing as that of the co-accused who was granted anticipatory bail by the Co-ordinate Bench on September 22, 2023 passed in C.R.M. (A) 3874 of 2023.

Consequently, we grant anticipatory bail to the petitioner. Accordingly, we direct that in the event of arrest, the petitioner shall be released on bail upon furnishing a bond of Rs.10,000/-, with two sureties of like amount each, to the satisfaction of the arresting officer and also be subject to the conditions as laid down under Section 438(2) of the Code of

Criminal Procedure, 1973. The petitioner shall appear on every date before the Jurisdictional Court on and from the date fixed for appearance of the accused and in default the jurisdictional Court will pass appropriate order to secure the presence of the petitioner in Court including cancelling the anticipatory bail granted without further reference to this Court.
