The petitioner prays for implementation of the order of demolition passed by the Bally Municipality. It appears that the person aggrieved preferred a statutory appeal and the same stood dismissed on contest vide order dated 19th December, 2023. Learned advocate representing the private respondents submits, upon instruction that, an appeal being Misc Appeal No. 224 of 2024 has been filed before the District Judge, Howrah and the date for admission has been fixed by the Court on 7th of May, 2024. The Bally Municipality is directed to take steps for implementing the order of demolition in the event no stay is granted by the appellate Court.

The writ petition stands disposed of.
