The petitioner is an Assistant Teacher at Mouri Majhina Free Primary School under Ketugram West Circle of the District Primary School Council, Purba Bardhaman. She is praying transfer to any school nearer to her residence under the same Council on medical ground and also on the ground that she is a surplus teacher of her present school. The medical ground(s) are not very much convincing. However, if the petitioner is a surplus teacher, her prayer for transfer to a school where there is shortage of teachers can be considered. The petitioner is permitted to file an appropriate representation before the Chairman of the said Council, the respondent no.7 herein praying for such transfer only on the ground that she is a surplus teacher of her present school; if

such a representation is made, the respondent no.7 shall consider the same in accordance with law and if the prayer of the petitioner is found to be bona fide, then the said respondent shall arrange for her transfer to any school under the said Council, preferably to a school nearer to her residence. WPA 3166 of 2025 is disposed of with the above terms without any order as to costs.
