Petitioner has prayed for expeditious disposal of CNS 417 of 2020 pending before the learned Judicial Magistrate, 8th court, Calcutta under Section 138 of the N. I. Act.

Record reflects that the learned Magistrate has fixed dates for evidence, however the same is not proceeding. Learned Magistrate is directed to fix at least one date in every forty-five days so that the trial of the case can be taken to its logical conclusion within a reasonable period of time.

Learned advocate also submits that till date the proceedings under Section 421 of the Code of Criminal Procedure is pending for recovery of the interim compensation. The learned Magistrate is directed not to fix both the dates together and for the purposes of the case relating to interim compensation, a date be fixed once in a month.

All efforts be taken so that the prosecution evidence is completed within a period of six months from the next date so fixed. The learned trial court will thereafter fix dates for examination of

accused under Section 313 Cr.PC, defence witnesses and take steps to conclude the trial as early as possible. . With the aforesaid observations, the revisional application being CRR 535 of 2024 is disposed of. Pending applications, if any, are consequently disposed of.
