W.P.A. 2941 of 2023 (Subhash Das & Ors. vs. State of West Bengal & Ors.) Mr. Raju Mondal .... For the Petitioners Mr. C. C. De Mr. Anirban Sarkar .... For the State Affidavit of service filed on behalf of the petitioners is taken on record.

It is submitted on behalf of the petitioners that their land was utilised by the State respondents for reconstruction of embankment in the Aila affected area of Sundarbans. Acquisition proceeding being LA case 4/6 of 2012-13 was initiated, but no compensation was paid to the petitioners. The petitioners submitted representations before the concerned authority in this regard, being Annexure P/2 to the writ petition which are yet to be considered. The petitioners pray for a direction upon the authority to consider the representations at the earliest.

It is submitted on behalf of the respondents that the 5th respondent be directed to consider the representations, in accordance with law.

In view of the above, the writ petition is disposed of directing the 5th respondent to consider and dispose

of the representations submitted by the petitioners (Annexure P/2 to the writ petition) within two months from the date of communication of this order upon affording reasonable opportunity of hearing to all the interested persons including the petitioners, in accordance with law.

In the event the petitioners are found entitled to compensation, the third respondent is directed to pay such compensation to the petitioners within two months thereafter.

The writ petition is thus disposed of.

There shall be no order as to costs.

Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted.

Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
