The petitioner's bail prayer was turned down on merits by an order passed on 6th May, 2024 in CRM (DB) 1435 of 2024. The petitioner renews his prayer on medical ground. A report is submitted by the State which demonstrates that the petitioner is suffering from various health issues and his physical condition is not so good. The attending doctor has recorded in the prescription issued on 4th February, 2025 that the petitioner was not on any medication and no blood test was undergone by him.
Upon consideration of the merits of the case, this Court is not inclined to release the petitioner on bail at this stage. Accordingly, the prayer for bail is rejected. However, considering the medical condition of the petitioner as appears from the report submitted by the State, the Superintendent, Berhampore Central Correctional Home is directed to render all possible medical assistance to the petitioner and
submit a report with regard to his health condition before the learned trial Court on the next date fixed before the learned trial Court. If it is found that the petitioner cannot be adequately treated in the correctional home or in Murshidabad Medical College and Hospital, Berhampore, the Superintendent shall take necessary advice of the doctor and consider his treatment before any other Government hospital as advised by the doctor. Case Diary be returned.
The application for bail is disposed of.
