The State of West Bengal and another Mr. Md. Abdur Rakib Mr. Somnath Adhikary Mr. Mojahid Mehedi .. for the petitioner The petitioner seeks quashing of proceeding of G.R. Case No.2907 of 2024 pending before the learned Chief Judicial Magistrate, Murshidabad and stay of warrant of arrest issued against him vide order dated 15th December, 2024. Learned counsel for the petitioner submits that in the first charge-sheet submitted by the investigating officer, the petitioner was discharged with an observation that no evidence was found against him. He was implicated in the supplementary charge-sheet submitted by the investigating officer. Upon receipt of the supplementary charge-sheet warrant of arrest has been issued against him.

The petitioner undertakes to surrender before the learned Chief Judicial Magistrate, Murshidabad at Berhampore within 10 days from date. If the petitioner surrenders before the learned Magistrate within 10 days from date and files an application for bail, the learned Magistrate shall deal with the same, in accordance with law.

In the event the petitioner fails to surrender within the stipulated time frame, the learned Magistrate shall take necessary

steps against the petitioner in accordance with law without further reference to this court.

The warrant of arrest issued against the petitioner vide order dated 15th December, 2024 be stayed till 3rd April, 2025. CRR 618 of 2025 is accordingly disposed of.
