Akkas Sarkar @ Raju Sarkar v. State Of West Bengal
05/03/2026 D/L - 38 Court No.28 S. Kundu Rejected C.R.M.(A) 541 of 2026 In Re: An application for anticipatory bail under Section 482 of the BNSS, 2023. In connection with Singur P.S case no. 669 of 2025 dated 12/12/2025 under Sections 137(2)/126(2)/127(2)/115(2)/117(2)/118(2)/303(2)/3(5) of the IPC and Sections 25/27 of the Arms Act. In the matter of: Akkas Sarkar @ Raju Sarkar
...Petitioner.
Mr. Manjit Singh Mr. Sk. Shaid Hossain Mr. Arkaprabho Roy Mr. Biswajit Mal ...for the petitioner.
Mr. Dibashis Basu Mr. Arun Bandyopadhyay ...for the de-facto complainant.
Mr. Soumik Ganguly Ms. Suruchi Saha ...for the State.
1. Learned senior counsel appearing for the petitioner submits as follows. The petitioner has been falsely implicated in this case due to previous rivalry. No grievous injury was caused to anyone.
2. Learned counsel appearing on behalf of the de-facto complainant strongly opposes the prayer for anticipatory bail. There is a provision of grievous hurt present in the charges.
3. Learned counsel appearing for the State opposes the prayer for anticipatory bail. He refers to the injury report and to the statements of the victim as well as the independent witnesses who named the present petitioner
as the one who had come along with his associates in five or six cars and had pointed a revolver at the head of the victim. Thereafter, the victim was assaulted.
4. Considering the above and the other materials available in the case diary, I do not consider this to be a fit case to grant anticipatory bail to the petitioner.
5. Accordingly, the application for anticipatory bail is rejected.
