In Re: An application under Section 397/401, read with Section 482 of the Code of Criminal Procedure, 1973;

Tapan Kumar Kayorhi

Versus

Nakul Chandra Mondal Mr. Sujoy Sarkar Mr. Rahul Chachan.

...for the petitioner.

There is a delay in preferring the revisional application for a period of 160 days. The reasons so assigned are found to be just and sufficient. Accordingly, the delay is condoned. Thus, CRAN 1 of 2023 is allowed.

Learned advocate appearing for the petitioner submits that the amount of interim compensation granted by the learned Judicial Magistrate, 1st Court, Bolpur, Birbhum is a sum of Rs.1,00,000/- which is creating hardship for the present petitioner who has been arraigned in the present case.

In view of the prayer so advanced, the interim compensation is reduced to a sum of Rs.75,000/- to be deposited by 14th July, 2023 before the learned Judicial Magistrate. The learned Judicial Magistrate will thereafter once in a month fix a date so that the trial is concluded by 31st December, 2023. With the aforesaid observations, CRR 439 of 2023 is disposed of.

Pending application, if any, is consequently disposed of. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
