1. The petitioner was admittedly married to one Niranjan Maiti, during the subsistence of the latter's marriage with one Susama Maity. She claims that the widowed daughter of Niranjan Maiti from Susama Maity, lawfully wedded wife, is now receiving pension as widowed daughter.
2. Mr. Manna seeks to produce two letters purportedly issued by the said widowed daughter namely Sipra Adhikari, and her husband Premananda Adhikari, that she is neither a widow nor is she receiving any pension.
3. Having regard to the facts and circumstances of the case, this court directs Mr. Manna to hand over the two letters to learned counsel for the State Mr. Suman Dey.
4. Let the letters be passed on to the DPPG, West Bengal along with a copy of the writ petition.
5. While it is true and fairly admitted by Mr. Manna that his client may not be entitled to pension as she was not
lawfully married to late Niranjan Maiti the resources of the State cannot be wasted.
6. Let the DPPG, West Bengal carry out an appropriate enquiry and take steps in accordance with law as expeditiously as possible.
7. Let a copy of this order be sent by learned counsel for the parties to the private respondents.
8. The writ petition is disposed of.
9. There shall be no order as to costs.
10. All parties shall act on the server copy of this order duly downloaded from the official website of this court. (Rajasekhar Mantha, J.)
