This revisional application has been filed praying for expeditious disposal of the Title Suit No. 155 of 2000, pending before the learned Civil Judge (Junior Division), VIth Court at Howrah.

It is contended that the suit has been pending for a long time and there has not been much progress in the suit. It is also contended that there was several rounds of litigation arising out of the said suit before the High Court and also the Apex Court. It is further stated that an application under Order 6 Rule 17 of the CPC is still pending.

Under such circumstances, without going into the merits of the suit and the claims of the petitioner, this revisional application is disposed of with a direction upon the learned court below to dispose of the application for amendment of the plaint within two months from the next date fixed. After disposal of the application under Order 6 Rule 17 of the CPC, the learned court below shall make sincere efforts to dispose of the Title Suit within a year therefrom.

This court has not gone into the merits of the claims of the petitioner and the learned court below shall proceed independently and in accordance with law.

The revisional application is disposed of. There shall be no order as to costs.

Petitioner is directed to serve a copy of the revisional application along with the server copy of this order upon the opposite party within seven days from date.

Urgent photostat certified copy of this order, if applied for, be given to the parties as expeditiously as possible subject to compliance of all usual formalities.
