202 25.02.2026 ss CRM (M) 415 of 2026 In the matter of : An application for bail under section 439 of the Code of Criminal Procedure/section 483 of BNSS, 2023 filed in connection with Panchla P.S. Case No. 272 of 2022 dated 24.07.2022 under sections 498A/302/34 of the Indian Penal Code.

And In the matter of : Najimul Hasan Ali Middya @ Najimul Hasan Middya Mr. Anindya Ghosh Ms. Sumita Sarkar ... ... for the petitioner Mr. Sardar Sahin Imam Mr. Tirthankar Dhali ... ... for the State Learned advocate appearing for the petitioner submits that the petitioner is in custody for 2 years and 11 months and 10 witnesses have been examined out of cited 20 witnesses, although there were earlier directions for concluding the trial within schedule period of time. Learned advocate appearing for the State opposes the prayer for bail and submits that there is a statement of the daughter of the deceased as well as the post-mortem report. I have taken into account both the documents which have been emphasized by the learned advocate for the State. I have considered that the petitioner except being the husband is similarly placed as the other accused persons who are on bail. Considering the same and the period of detention already

suffered by the present petitioner, I am of the view that further detention is unwarranted.

Accordingly, the prayer for bail of the petitioner is allowed.

The petitioner shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties of Rs.10,000/- each, one of whom must be local to the satisfaction of the learned CJM, Howrah. If on bail, the petitioner shall be physically present on each and every date fixed before the learned trial court and shall not leave the district of Howrah without the prior permission of the learned Court below.

Accordingly, CRM(M) 415 of 2026 is allowed.
