For the State Learned counsel appearing for the petitioner on instruction submits that during the pendency of the application the petitioner has been arrested. Learned counsel representing the State has produced the statement of the victim under Section 164 of the Code of Criminal Procedure.

However, as the petitioner was arrested during the pendency of the application, the application for anticipatory bail has become infructuous.
