Petitioners are aggrieved by the fact that they are owners in respect of a property which the private respondent nos. 7 to 15 are trying to grab by flexing their muscle power. There has been threat, abuses and unnecessary disturbances created by the private respondents for which the petitioners complained before the Officer-in-charge of Burwan Police Station. State has submitted a report which reflects that in respect of the information so furnished with the Officer-in-charge of the police station, already

proceedings have been drawn up under section 126/135 of the BNSS and the police authorities claim that the nature of the dispute being civil, they are reluctant to act on such complaint.

Mr. Das, learned advocate appearing on behalf of the private respondents submits that the petitioner is accusing falsely and frivolous allegations have been made in the information furnished to the police authorities, as such the police authorities themselves are reluctant to act on such information. Be that as it may, prima facie it appears that both the parties are in a strained relationship. Accordingly, police authorities would ensure that there is no breach of the peace and tranquility and/or any untoward incident resulting from the inimical relationship existing between the parties. With the aforesaid observations WPA 3160 of 2025 is disposed of.

Report so submitted be kept with the record.

A copy of the report be handed over to the learned advocate appearing for the petitioner. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
